 Action Description for DOH Webpage:From the effective date of this modification order, the physician shall be subject to an additional three-year period of monitoring with terms that include a practice monitor, Continuing Medical Education, compliance with Article 33 and consultation of iSTOP when writing prescriptions for Schedule II, III and/or IV controlled substances and maintenance of a controlled substance prescription log. All other terms and conditions of the Original Order remain in effect. While the physician is a licensee in New York State, they remain permanently precluded from evaluating, treating or billing patients whose medical services are reimbursed through either No Fault Insurance or Workers' Compensation; the physician may not order, perform or interpret electro diagnostic nerve and muscle studies and must refer patients requiring those services to an independent and financially disinterested physician. The physician may only form, own or control one professional medical corporation or other professional entity at any one time and their own medical practice must be performed at that practice site of the corporation and/or entity. The physician paid the fine on March 12, 2019 and completed probation on October 17, 2019.
 Misconduct Description for DOH Webpage:This order is a modification of the terms and conditions previously imposed under BPMC Order#16-331 that went into effect on October 18, 2016 and does not constitute a new disciplinary action. The physician asserted they could not successfully defend against at least one of the acts of professional misconduct involving charges of negligence and incompetence on more than one occasion; failing to maintain accurate records; practicing fraudulently and filing false reports.
  License Limitations or Conditions for DOH Webpage: During the period of monitoring, the physician may only practice medicine when their practice is being monitored by a licensed physician, board certified in an appropriate specialty, and approved by the Director (Director) of the Office of Professional Medical Conduct; must enroll in and successfully complete Continuing Medical Education approved by the Director; comply with all requirements of Article 33 of the New York State Public Health Law including the consultation of the iSTOP registry when writing prescriptions for Schedule II, III and/or IV controlled substances as well as maintenance of a prescription log in an approved format.
