Action Description for DOH Webpage:The physician’s period of probation previously imposed is terminated upon the effective date of this order. However, the physician must provide ninety days written notice to the Director of the Office of Professional Medical Conduct prior to any resumption of surgical or hospital-based medical practice. Upon such resumption of surgical or hospital-based practice the physician may be subject to further conditions. The following procedures are not considered to be surgical in nature: physical examinations including breast and pelvic examinations; infection checks such as cultures, vaginal smears and wet mounts; urinalysis evaluations; colposcopy with or without biopsies; cervical and/or endometrial biopsies; incision and drainage of vulvar cysts and/or abscesses; prenatal care; clinical pelvimetry and simple ultrasound examinations performed during the practice of Obstetrics and Gynecology.
Misconduct Description for DOH Webpage:This order is a modification of the terms previously imposed by BPMC Order #14-15 and does not constitute a new disciplinary action. Previously the Review Board had affirmed the Hearing Committee’s June 19, 2013 determination finding the physician guilty of having been convicted in the United States District Court, Southern District of New York of Conspiracy to Commit Bribery. The Review Board had overturned the Hearing Committee’s penalty of revocation and had suspended the physician’s medical license for two years, the suspension was stayed with probation for five years. Before the Hearing Committee’s Order on November 8, 2012 the physician’s New York State medical license had been summarily suspended by the New York State Commissioner of Health.
License Limitations or Conditions for DOH Webpage: The physician must provide at least a ninety days notice to the Director of the Office of Professional Medical Conduct prior to any resumption of surgical or hospital based medical practice.
