| Misconduct Description for DOH Webpage: | The Hearing Committee effective January 25, 2006 sustained the charges finding the physician guilty of gross incompetence; negligence and incompetence on more than one occasion; failure to maintain accurate records; filing a false report; practicing fraudulently and violating New York State Public Health Law Section 2805-k(c). On January 31, 2006 the New York State Supreme Court, Appellate Division, Third Department granted the physician a temporary stay of the penalty; however the physician is subject to the condition that he can not treat any patient/person under 20 years of age, under any circumstances.L ater the New York State Supreme Court, Appellate Division, Third Department denied a stay of the revocation pending the Court's decision, therefore the revocation again goes into effect on March 13,2006. On May 10, 2007 the New York State Supreme Court, Appellate Division, Third Department confirmed the Hearing Committee's determination and dismissed the physician's petition. |
