Previously the Review Board sustained the Hearing Committee's May 28, 2003 determination finding the physician guilty of gross negligence and practicing fraudulently. The Review Board modified the Hearing Committee's penalty by overturning the penalty of performing five hundred hours of community service and fining the physician $5,000. The New York State Supreme Court, Appellate Division, Third Department on December 23, 2004 upheld the Review Board's penalty. |
