| | Misconduct Description for DOH Webpage: | The Review Board sustained the Hearing Committee's January 28, 2002 determination dismissing the charges of negligence, ,incompetence and failure to maintain accurate records. The Review Board sustained the charge that the physician failed to comply with a comprehensive medical record review board order. Previously the New York State Supreme Court, Appellate Division Third Judicial Department granted the physician begining June 27,2002 a stay of the Review Board's initial June 20, 2002 penalty of suspension until the Court's decision of the appeal. On October 23, 2003 the New York State Supreme Court, Appellate Division Third Judicial Department's decision upheld the initial Review Board's determination but annulled the penalty and remanded the matter to the Review Board for imposition of an appropriate penalty which was imposed March 25, 2004. |
