| | Misconduct Description for DOH Webpage: | The Review Board sustained the Hearing Committee's March 28, 1996 penalty and determination finding the physician guilty of gross negligence, negligence and incompetence on more than one occasion; failing to maintain accurate patient records and failing to comply with New York State Public Health Law Section 4164(1) which provides that when an abortion is performed after the twentieth week of pregnancy, another physician must be in attendance to provide for any live birth that is the result of the abortion.The physician's New York State medical license was previously summarily suspended on August 16, 1995. |
