| | Misconduct Description for DOH Webpage: | This order is a modification of order BPMC 96-116 and does not constitute a new disciplinary action. The license restriction that prohibits the physician from prescribing Schedule II controlled substances is no longer in effect. Previously the Review Board had sustained the Hearing Committee's May 21, 1996 determination that the physician was guilty of having been found in violation of Article 33 of the New York State Public Health Law by issuing a prescription for the controlled substance Tylenol with Codeine #4 which would exceed a thirty day supply and failing to maintain a patient record justifying the use of Tylenol with Codeine #4. The Review Board overturned the Hearing Committee's penalty of censure and reprimand and imposed a license limitation with a thirty day suspension. |
