| Action Description for DOH Webpage: | Censure and reprimand and the physician’s New York State medical license shall permit them to prescribe, dispense, order and/or administer non-controlled substances and shall be limited to permit them to prescribe, dispense, order and/or administer Propofol, benzodiazepines, Ketamine, inhaled anesthetics, muscle relaxants, antiemetics, anti-inflammatory and non-opioid topicals, only in a setting license under Article 28 of the Public Health Law. Any patients being prescribed controlled substances other than those listed and/or other than in a setting licensed under Article 28 of the Public Health Law prior to the execution of this agreement, shall upon execution of this agreement, be referred to another health care provider who can exercise their independent judgement and discretion regarding continuing and/or modifying their necessity and/or use of controlled substances. The physician shall enroll in and successfully complete Continuing Medical Education approved by the Director of the Office of Professional Medical Conduct. The physician must also fully comply with the 2022 and 2024 Florida Board of Medicine Board Orders and any extension or modification thereof. |
| Misconduct Description for DOH Webpage: | The physician did not contest the allegations, in full satisfaction of the charges of misconduct, by having been disciplined by the State of Florida Board of Medicine for falling below the standard of care by failing to consult with the patient’s prior or current health care providers; improperly relying on the patient’s self-reporting; failing to gather an adequate medical history of the patient; performing inadequate physical examinations of the patient; failing to assess or monitor the patient for substance abuse; having an inadequate treatment plan and failing to follow through with the treatment plans that had been made; making diagnoses that were not supported by the documentation; prescribing medications without a legitimate medical purpose; prescribing a legend drug inappropriately or in excessive or inappropriate quantities and failing to maintain adequate medical records. |
