 Action Description for DOH Webpage:License suspension wholly, until the physician complies with the terms and conditions of this board order, specifically, the physician shall take courses in medical recordkeeping and I-STOP which must be approved by the Director of the Office of Professional Medical Conduct. The courses must be completed no longer than six months prior to seeking to resume the practice of medicine in New York State. The Administrative Review Board modified the Hearing Committee penalty with 3 years’ probation to commence after the suspension has been lifted with monitoring by a licensed physician, board certified in an appropriate specialty and approved by the Director of the Office of Professional Medical Conduct. The physician’s New York State medical license is also permanently limited to the practice of Psychiatry and the physician may not practice Pain Management or order, distribute, dispense, administer, or prescribe Schedule II medications.
 Misconduct Description for DOH Webpage:The Administrative Review Board affirmed the Hearing Committee December 15, 2021 determination finding the physician guilty of committing professional misconduct by having been disciplined by the Alabama State Board of Medical Examiners for dispensing opioids in amounts not reasonably related to the proper medical management of a patient’s illness or conditions; failing to properly utilize toxicology screening; make chemical dependency referrals and obtain chemical dependency consults; keep accurate, complete and legible records; consider and document non-narcotic and alternative treatment modalities; employ risk and abuse mitigation strategies when prescribing controlled substances by failing to document the use of risk and abuse mitigation strategies when prescribing controlled substances for the treatment of pain, and failing to query the PMP when prescribing controlled substances.

The courses must be completed no longer than six months prior to seeking to resume the practice of medicine in New York State. After the suspension is lifted, the physician will serve 3 years’ probation during which he may only practice medicine when monitored by a licensed physician, board certified in an appropriate specialty and approved by the Director of the Office of Professional Medical Conduct. The physician’s New York State medical license is also permanently limited to the practice of Psychiatry and the physician may not practice Pain Management or order, distribute, dispense, administer or prescribe Schedule II medications. Upon the completion of the courses, the physician will be placed on probation with conditions for three years. During the period of probation, the physician shall only practice medicine when their practice is being monitored by a licensed physician, board certified in an appropriate specialty.
