 Action Description for DOH Webpage:From the effective date of this modification order, the period of probation shall be terminated and the physician shall adhere to federal and state guidelines regarding appropriate infection control practices and engage Infection Control Consulting Services (ICCS) or another independent infection control consultant approved by the Director (Director) of the Office of Professional Medical Conduct. The infection control consultant shall be required to perform a thorough initial assessment of any location in New York State where the physician engages in the practice of medicine to ascertain whether there are deficiencies in the physician’s infection control and/or hygiene practices including cleanliness and sanitary conditions. The infection control consultant shall determine the necessity of a remediation plan and if appropriate develop and prepare a plan for delineating remediation which must be submitted to the Director for approval. The infection control consultant will perform site visits to the location(s) the physician practices to assess and ensure the continued compliance with the recommendations made by the consultant as well as the compliance with the remediation plan and proper cleanliness and infection control standards during the practice of medicine. The conditions of this modification order shall be applicable to any location of practice by the physician in New York State and the infection control consultant conditions shall remain in effect until September 24, 2024. The physician shall enroll in and successfully complete Continuing Medical Education approved by the Director and all remaining terms and conditions will continue as written in the Original Order.
 Misconduct Description for DOH Webpage:This order is a modification of the terms and conditions previously imposed under BPMC Order #21-194 that went into effect on September 24, 2021 and does not constitute a new disciplinary action. The Administrative Review Board affirmed the Hearing Committee’s April 14, 2021 determination finding the physician committed professional misconduct by having been disciplined by the New Jersey State Board of Medical Examiners for failing to develop and implement adequate infection control, waste management, and/or medical equipment maintenance protocols and failing to adequately monitor and manage his inventory of medications and medical supplies.
