 Action Description for DOH Webpage:Censure and reprimand and probation for thirty-six months with conditions. The physician is subject to a license limitation precluding the prescribing, dispensing, ordering and/or administering of any controlled substances until the Director of the Office of Professional Medical Conduct (Director) reviews the results of the Clinical Competency Assessment (CCA) and determines that any corrective action or retraining has been successfully completed. The CCA must be completed and a report given to the Director within sixty days of the effective date of this board order unless the Director has given an extension. Following the completion of the CCA the physician must identify a Preceptor, preferably a physician who is board certified in the same specialty and approved by the Director who can address any deficiencies or retraining identified in the CCA. Any current patients receiving controlled substances shall be referred to another health care provider, who she does not supervise, who will exercise their independent judgment in prescribing. During the period of probation, the physician may only practice medicine when her practice is being monitored by a licensed physician, board certified in an appropriate specialty. The physician must comply with the requirements of Article 33 of the New York State Public Health Law regarding the consultation of iStop when writing prescriptions for Schedule II, III and/or IV controlled substances; must maintain a prescription log and successfully complete a Continuing Medical Education program. The Director may impose additional terms and conditions based upon all relevant facts and circumstances known to her from the results of the CCA, her Preceptor and/or probation.
 Misconduct Description for DOH Webpage:The physician asserted she could not successfully defend against at least one of the charges of misconduct alleged by practicing the profession of medicine with negligence on more than one occasion and failing to maintain accurate patient medical records.
