| | Misconduct Description for DOH Webpage: | The Administrative Review Board affirmed the Hearing Committee's August 25, 2016 determination finding the physician guilty of professional misconduct by having committed negligence on more than one occasion; ordering excessive tests and treatments not warranted by the patient’s condition; practicing fraudulently and failing to maintain accurate patient medical records. The Administrative Review Board affirmed that part of the Hearing Committee's penalty suspending the physician's New York State medical license for ninety days followed by probation for five years under terms that include a practice monitor. The Administrative Review Board overturned the portion of the Hearing Committee's penalty limiting the physician practice of medicine to only a facility regulated under New York State Public Health Law Article 28, instead the Administrative Review Board banned the physician from the solo practice of medicine and from owning a Professional Corporation. Previously the Supreme Court of the New York State Appellate Division, Third Department had granted the physician a temporary stay of the New York State Board for Professional Medical Conduct's Hearing Determination and Order pending the Court's hearing and determination of the physician's motion for a stay. This stay was later vacated by the Supreme Court of the New York State Appellate Division, Third Department on October 12, 2016. |
