 Action Description for DOH Webpage:This order is a modification of the terms previously imposed on November 17, 2016 and does not constitute a new disciplinary action. This modification shows the physician has ceased any and all electro diagnostic testing and does not intend to resume such practice or to have any physician or other practitioner employed by him or by his practice to engage in electro diagnostic testing. In the future should the physician decide to resume electro diagnostic testing personally or through practitioners employed by him or his practice he must provide ninety days advanced written notice to the Director of OPMC and shall not resume such practice until he receives approval from the Director of OPMC. All other terms and conditions of Board Order 16-369 remain in effect as the physician was censured and reprimanded with a $10,000 fine and probation for thirty-six months. The physician paid the fine on December 5, 2016 and completed probation on November 16, 2019. The permanent restriction regarding forming, owning, or controlling more than one professional medical corporation or professional practice at any time remains in effect. The physician may own, form, or control any such single professional practice entity (SPPE) only if his own medical practice is performed at the practice site of that SPPE. The restriction from any and all electro diagnostic testing as well as treatment of patients whose services are billed through No Fault or Workers’ Compensation is now terminated, however, should the physician decide in the future to resume such testing or treatment, personally or through practitioners employed by him or his SPPE, before beginning such practice he must provide ninety days advance written notice to the Director of the Office of Professional Medical Conduct, receive the Director’s approval and may be subject to further conditions imposed by the Director.
 Misconduct Description for DOH Webpage:The physician asserted he could not successfully defend against at least one of the acts of professional misconduct by practicing the profession of medicine with negligence on more than one occasion and failing to maintain accurate patient medical records.
