| Misconduct Description for DOH Webpage: | The Administrative Review Board affirmed the Hearing Committee’s December 18, 2018 determination finding the physician guilty of having committed professional misconduct by having been convicted in the United States District Court, District of the State of New Jersey of Conspiracy to Violate the Federal Anti-Kickback Statute and Travel Act and to Defraud Patients of Honest Services; Illegal Remuneration in Violation of the Federal Anti-Kickback Statute; Use of the Mail and Facilities in Interstate Commerce and Interstate Travel to Promote, Carry On and Facilitate Commercial Bribery and Scheme to Defraud Patients of Honest Services by Accepting Bribes. The Review Board was unable to overrule by a majority the Hearing Committee’s penalty determination and therefore the original decision remains in effect. Previously on August 29, 2018, the physician’s New York State medical license had been summarily suspended by the New York State Commissioner of Health. |
