 Action Description for DOH Webpage:The Administrative Review Board affirmed the Hearing Committee's penalty suspending the physician's license to practice medicine for fifteen months with probation for forty months and conditions following the period of suspension. The physician must also pay the remaining balance of the previously imposed fine of $6,000. The physician's medical license is also permanently limited precluding the physician from individually or through a professional corporation from evaluating, treating or billing patients whose medical services are reimbursed through No-Fault Insurance or Workers' Compensation. The Review Board did impose additional conditions requiring the physician to pay the $6,000 fine in installments over six months beginning within 30 days of the effective date of this order and requiring that the physician has an approved practice monitor, appropriate malpractice coverage and has completed the required CME courses prior to the commencement of his probationary period.
 Misconduct Description for DOH Webpage:The Administrative Review Board affirmed the Hearing Committee's October 18, 2017 determination finding the physician guilty of having committed professional misconduct by violating the terms of BPMC Order # 09-231 previously imposed by the New York State Board for Professional Medical Conduct by failing to pay the entire $10,000 fine; practicing medicine without oversight by an approved practice monitor; practicing medicine without the required malpractice insurance coverage and failing to complete the continuing medical education courses within the first ninety days of the probationary period.
  License Limitations or Conditions for DOH Webpage: The probationary period includes twenty-four months wherein the physician may only practice medicine when his practice is being monitored by a licensed physician board certified in an appropriate specialty. The physician is permanently precluded from, individually or through a professional corporation, evaluating, treating or billing patients whose medical services are reimbursed through No-Fault Insurance or Workers' Compensation.
