| Action Description for DOH Webpage: | License suspension for an indefinite period but no less than twelve months effective immediately upon the physician’s release from incarceration. During the period of suspension, the physician is precluded from practicing as a physician and from reliance upon their New York State medical license to exempt them from the licensure, certification or other requirements set forth in statute or regulation for the practice of any other profession licensed, regulated, or certified by the New York State Board of Regents, New York State Department of Education, New York State Department of Health or the New York State Department of State. The physician must obtain and complete a Clinical Competency Assessment (CCA) approved by the Director (Director) of the Office of Professional Medical Conduct as well as identify a Preceptor, preferably a physician board certified in the same specialty and approved by the Director, who can develop a remediation plan to address any deficiencies or retraining recommendations identified in the CCA. Upon a showing to the satisfaction of a Committee on Professional Medical Conduct that the physician is both fit and clinically competent to practice medicine, the suspension will be terminated, and the physician will be placed on probation for five years with conditions. The Director may also impose additional terms and conditions based on all relevant facts and circumstances. The physician’s New York State medical license is permanently limited to preclude the prescribing, dispensing, administering and/or ordering of controlled substances. Previously on January 7, 2019, the physician was subject to an Interim Non-Disciplinary Order of Conditions. |
