 Action Description for DOH Webpage:The requirements within the Commissioner’s Summary Order has been lifted and the physician remains subject to Order #17-289 that precludes him, his designee(s) or any practitioners or others in his employ from the preparation, handling and administration of any form of substance to be given intravenously; performing any and all intravenous services and compounding of medications to include combining, mixing, or altering of ingredients of a drug to create a medication tailored to the needs of one or more individual patients. The physician shall be placed on probation for thirty-six months with conditions.
 Misconduct Description for DOH Webpage:The physician did not contest the charge of committing professional misconduct by failing to comply with scientifically accepted barrier precautions and infection control practices regarding office procedures, staff and personal hand hygiene, and medication preservation, preparation, handling and administration. The physician permitted, aided, or abetted medical or nursing practices by his staff unauthorized by license to engage in those practices and failed to produce all such records, failed to make available for interview those of his staff members who possessed such information and negligence on more than one occasion. Previously, on September 7, 2017, the physician was subject to BPMC order #17-254 precluding him from performing and/or allowing or directing staff to perform phlebotomy, infusions, injections, and the preparation of medication for infusions and/or injections and then later on September 8, 2017, the physician was subject to a Commissioners Summary Order precluding him from the practice of medicine in New York State. Later on October 27, 2021 the Commissioner’s Summary Order was formally rescinded.
  License Limitations or Conditions for DOH Webpage: During the period of probation the physician may only practice medicine when his practice is being monitored by a licensed physician, board certified in an appropriate specialty and, for a period of at least three months, by an on-site infection prevention and control consultant. The physician is precluded, his designee(s) or any practitioners or others in his employ from the preparation, handling and administration of any form of substance to be given intravenously; performing any and all intravenous services and compounding of medications to include combining, mixing, or altering of ingredients of a drug to create a medication tailored to the needs of one or more individual patients.
