The physician remains subject to the original penalty of censure and reprimand and the physician must notify the Office of Professional Medical Conduct immediately if he returns to practice medicine in New York State.
Misconduct Description for DOH Webpage:This order is a modification of the terms and conditions previously imposed under BPMC# 19-186 effective July 29, 2019 and BPMC# 19-019 effective February 1, 2019 and does not constitute a new disciplinary action. Previously the Administrative Review Board had affirmed the Hearing Committee’s February 1, 2019 determination finding the physician guilty of having committed professional misconduct by having been disciplined by the Alabama State Board of Medical Examiners for failing to maintain a patient medical record which meets the minimum standards. The Administrative Review Board had amended the Hearing Committee’s citation on pages one and three changing the citation from EL § 6530(9)(a)(ii) to EL§ 6530(9)(d).
